What is casual loading?
Casual loading is an additional amount paid as part of a casual employee’s rate. Many awards use a 25% loading, but that should not be treated as a universal rule. Some instruments specify a casual rate or different calculation method. Check the worker’s classification, age, award or agreement and the applicable pay period.
Who is a casual employee?
Under the current Fair Work framework, casual status involves the employment relationship at commencement, including no firm advance commitment to ongoing work and an entitlement to a casual loading or specific casual rate. The real substance and practical reality matter. A regular roster alone does not determine status, and merely labelling a contract “casual” does not settle the question.
How to check the rate
- Confirm national-system coverage and the applicable award or enterprise agreement.
- Find the correct classification, age and any apprenticeship or supported-wage provisions.
- Use the instrument’s casual rate and calculation method.
- Check weekend, overtime and public-holiday treatment separately.
- Keep payroll records and identify the loading transparently in the contract and pay records.
Use Fair Work’s Pay and Conditions Tool and pay guides. A flat rate needs to cover all entitlements that lawfully apply; calling it “all inclusive” is not enough.
Loading and penalty rates
Do not automatically add 25% to a published casual penalty rate: it may already include loading. Nor should you assume loading replaces overtime or weekend penalties. Awards and agreements differ in whether amounts are added, compounded or expressed as a single rate. Check the actual wording.
Loading does not buy out every entitlement
Casual employees can have entitlements including superannuation where applicable, unpaid carer’s and compassionate leave and paid family and domestic violence leave. Loading does not replace statutory workplace protections. Eligibility and payment rules must be checked for the entitlement concerned.
Moving to permanent employment
Eligible casual employees may use the employee-choice pathway under the Fair Work Act. Review eligibility, notification and employer-response requirements using current official guidance. Do not assume old casual-conversion template clauses still describe the operative pathway.
Contract and payroll checks
Record the engagement model, classification, base and casual pay setting, applicable instrument and roster expectations without claiming guaranteed exclusion of permanent status. Give required information statements. See public holiday pay, enterprise agreements and fixed-term contracts.

Frequently asked questions
Is casual loading always 25%?
No. Many awards use 25%, but the applicable award, agreement or lawful pay setting must be checked for the particular worker and classification.
Is casual loading added to every penalty rate?
Not necessarily. A published casual penalty rate may already include loading, and instruments use different calculation methods. Check the actual award or agreement.
Can a casual employee have paid leave rights?
Yes. Casual employees can have paid family and domestic violence leave and other applicable entitlements. Casual loading does not replace every statutory entitlement.
