Common questions.
- Do I need a trade mark if I already have a business name registered?
- Yes. An ASIC business name registration does not give you brand rights — it just reserves the name. A registered trade mark with IP Australia gives you the exclusive right to use the mark in your class of goods or services across Australia for 10 years (renewable).
- How much does a trade mark cost?
- A single-class Australian trade mark filing is a fixed fee of around $1,200 + GST including our work and IP Australia fees. Additional classes are $400 + GST each. Objections and oppositions are scoped separately if they come up.
- Who owns the IP my freelancer created?
- Under Australian copyright law, the creator generally owns copyright — not the person who paid for it — unless there is a written assignment. If your logo, code or content was made by a contractor without a signed IP assignment, the IP may not sit with your company. We fix that.
- Can you file international trade marks?
- Yes — via the Madrid Protocol we can extend an Australian mark to key jurisdictions (US, UK, EU, Singapore and others) at a fixed fee per country.
