Website Content and Intellectual Property

Legalify (Client Portal)

Parts of the Website provide access to Legalify, our secure client portal (“Client Portal”). The Client Portal is made available to invited clients of Envision Legal to facilitate matter management, secure messaging, document sharing, e-signing and payment of invoices. Access to the Client Portal is granted by invitation only and is subject to these Terms, our Privacy Policy and any additional client engagement terms we provide to you.

By using the Client Portal you agree that: (a) you are authorised to access the account and any matters associated with it; (b) you will keep your login credentials confidential and will notify us immediately of any suspected unauthorised access; (c) you will not upload material that is unlawful, infringing, misleading or that contains malicious code; (d) documents, messages and information you upload or exchange through the Client Portal may be stored by us and our sub-processors (including cloud hosting providers located in Australia and, where relevant, overseas) for the purpose of providing legal services to you; and (e) while we take reasonable steps to secure the Client Portal, no online system is completely secure and you use it at your own risk to the extent permitted by law. We may suspend or terminate your access to the Client Portal at any time where reasonably required to protect the security or integrity of the system, comply with our legal or professional obligations, or where your engagement with us has ended.

Regulatory Radar, Guides, Checklists and Other Resources

Parts of the Website provide access to our Regulatory Radar, together with guides, checklists, explainers, the Legal Health Check and other downloadable or interactive resources (together, the “Resources”).

Source of the information

The Regulatory Radar is a summary of legislative, regulatory and policy developments compiled and extracted from publicly available sources, including Commonwealth, State and Territory legislation and explanatory materials, parliamentary and government announcements, regulator publications and media releases, court and tribunal decisions, and other publicly accessible material. We do not control those sources and the underlying material may be amended, withdrawn, superseded or corrected by its publisher at any time. Links and references are provided so you can consult the primary source yourself, and you should always do so before acting.

Not legal advice and not to be relied upon

The Resources, including the Regulatory Radar, are provided for general information purposes only. They are not legal advice, are not a substitute for legal advice, and are not intended to be relied upon as advice by you or by any other person. They do not take into account your objectives, circumstances, industry, jurisdiction or the particular facts of any matter. Nothing in the Resources creates a lawyer-client relationship between you and Envision Legal, and no duty of care is assumed by us in respect of your use of them. You should obtain specific legal advice from a qualified Australian legal practitioner before taking or refraining from taking any action.

Currency and accuracy

Regulatory developments move quickly. Each item in the Regulatory Radar reflects our understanding of the position as at the date shown on that item, and entries are not continuously monitored or updated after publication. Filters, categories, dates, status labels, risk or impact indicators, scores and any commentary are our own editorial characterisations and may be incomplete, simplified or wrong. While we take reasonable care in preparing the Resources, we give no warranty or representation (express or implied) that they are accurate, current, complete, applicable to your circumstances, or free from error or omission.

Assessments, scores and generated reports

Where a Resource produces a score, rating, result, summary or downloadable report (including the Legal Health Check and our interactive checklists), that output is generated automatically from the answers you provide. It is an indicative, self-assessment tool only, is not a legal audit, opinion or compliance certification, and must not be relied upon as advice or as evidence of compliance with any legal obligation. We are not responsible for the accuracy or completeness of the information you input.

Permitted use of the Resources

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access, view, download and print the Resources for your own internal business or personal reference. You must not (a) republish, redistribute, sell, licence, sub-licence or commercially exploit the Resources or any part of them; (b) remove or alter any attribution, disclaimer, copyright notice or branding; (c) present the Resources as your own, or as advice given to any third party; (d) systematically scrape, crawl, harvest, index or bulk-extract the Regulatory Radar or any dataset underlying it; or (e) use the Resources or any part of them to train, fine-tune or ground any machine learning or artificial intelligence model, without our prior written consent. Where a Resource incorporates material sourced from a third party, your use of that material remains subject to the rights of its owner.

Liability

To the fullest extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot lawfully be excluded, we exclude all liability for any loss, damage, cost or expense (including indirect or consequential loss, and loss of profit, revenue or opportunity) suffered by you or any other person arising from or in connection with access to, use of, or reliance on the Resources, the Regulatory Radar, or any material sourced from a third party. Where liability cannot be excluded, our liability is limited, at our option, to supplying the relevant Resource again.

We may add to, amend, suspend, withdraw or discontinue any Resource, including the Regulatory Radar, at any time without notice.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any legal action or proceeding arising out of or relating to these Terms or your use of the Website shall be brought exclusively in the courts located in New South Wales, Australia, and you consent to the jurisdiction of such courts.

Severability
