- No. ASIC registration and a domain give you no exclusive rights to a name. A registered trade mark is the only way to stop a competitor using a confusingly similar brand in your classes.
- How much does a trade mark cost in Australia?
- Our fixed fee for a clearance search plus filing typically runs $1,200–$2,200 + GST for one to two classes, plus IP Australia's official fees. Adverse report responses and oppositions are quoted separately.
- How long does registration take?
- About 7–8 months end to end if nothing goes wrong — roughly 3–4 months to examination, then a 2-month opposition period after acceptance. Protection runs back to your filing date once registered.
- Can I trade mark my logo and my name?
- Yes, and often you should file both — a word mark protects the name in any font, while a logo mark protects the visual identity. We advise which combination is worth the extra classes for your business.
