What a good chair rental agreement covers

The sham contracting risk

Under the Fair Work Act 2009 (Cth), it is unlawful to misrepresent an employment relationship as an independent contracting arrangement. From 26 August 2024 the question is answered by looking at the whole working relationship, not just the written contract. Commission-based arrangements where the salon controls the diary, prices and clients carry the greatest risk. Employees in the industry are generally covered by the Hair and Beauty Industry Award.

What is a salon chair rental agreement?

A chair (or booth) rental agreement lets an independent hairdresser, barber or beauty therapist rent space in your salon and run their own business from it. It sets the rent, what is included, booking and client ownership, hours, product use, insurance and how either side can end the arrangement.

Is a chair renter an employee or a contractor?

It depends on the real relationship, not the label. Since 26 August 2024 the Fair Work Act 2009 (Cth) looks at the whole of the working relationship. If you set their hours, prices and clients, take a commission and supply everything, they may be an employee — with award, superannuation and leave obligations. Misrepresenting employment as contracting is sham contracting.

Who owns the clients when a stylist leaves?

Only what the agreement says — and any restraint must be reasonable to be enforceable. Clear terms on client data, booking systems and social accounts avoid most disputes.
