An Australian general counsel with the experience to be useful on their own commands $200,000 to $350,000 base. - Total your last twelve months of legal invoices.
- Add the executive hours spent managing legal work, costed at their real rate.
- Add the deals delayed or terms accepted because legal review was too slow or too expensive. This is the number most businesses ignore and it is usually the largest.
- Set the retainer at roughly 60 to 70 per cent of the total. If the scope fits, you are ahead on both cost and coverage.
What Should Be In Scope
Rate alone tells you nothing. Compare inclusions: defined monthly hours, guaranteed turnaround, contract negotiation (not just review), template library ownership, employment queries, compliance monitoring, and board or leadership attendance. Then confirm what sits outside — litigation, large M&A, tax structuring and licensing applications normally do, and should be quoted as separate fixed fees rather than reverting to hourly billing.
Red Flags on Price
- A 12-month minimum term with no discount attached.
- "Unlimited" advice — it is either rationed in practice or the scope is very narrow.
