In short
A commercial property lawyer in Sydney reviews and negotiates the documents for leasing or buying business premises: heads of agreement, leases, assignments, options, guarantees and contracts for sale. Envision Legal quotes each matter as a fixed fee and works on the documents only, not disputes.
The lease is often a business's second-largest commitment after payroll. Most of its terms are set before the lawyers see it, so get advice early.
What we cover
- Heads of agreement: rent, incentives, term, options and make-good, before they are locked in.
- Lease review and negotiation: retail, office, warehouse and industrial leases. See commercial lease lawyers Sydney.
- Retail leases: whether the Retail Leases Act 1994 (NSW) applies, disclosure statements and outgoings.
- Assignments and subleases: including assignments as part of a business sale or business purchase.
- Guarantees and security: personal guarantees and bank guarantees, and how to limit them.
- Commercial property contracts: review of contracts for sale of commercial premises bought by a business.
How it works
- Send the heads of agreement, lease or contract with a note on the premises and your deadline.
- We quote a fixed fee, usually within one business day.
- We review and negotiate, with a plain-English summary of the terms that matter.

Frequently asked questions
What does a commercial property lawyer do?
Reviews and negotiates the documents for leasing or buying commercial premises: heads of agreement, leases, agreements for lease, assignments, options, guarantees and contracts for sale. Envision Legal works on the documents only and does not run property disputes or tribunal proceedings.
Should I get a lease reviewed before signing the heads of agreement?
Yes. Rent, incentives, term, options, make-good and outgoings are usually fixed at heads of agreement stage. Getting advice before you sign is cheaper than trying to renegotiate the lease later.
Is my lease a retail lease in NSW?
It depends on the use of the premises and the lettable area. Shops covered by the Retail Leases Act 1994 (NSW) attract extra protections, such as a disclosure statement and limits on some outgoings. We confirm whether the Act applies when we review the lease.
Can you help when I'm assigning a lease as part of selling my business?
Yes. We prepare or review the assignment, deal with the landlord's consent requirements and address any guarantee you have given, as part of the business sale timetable.
How are your commercial property fees structured?
Each matter is quoted as a fixed fee once we have seen the lease or contract and understood the deal. The scope is agreed in writing before work starts.
